These Terms of Service ("Terms") govern your access to and use of BrowardBark.com and any related pages, forms, directories, listings, newsletters, promotions, content, messages, products, services, and features operated by Case Breakers, Inc., doing business as Broward Bark ("Broward Bark," "we," "us," or "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.

2. Eligibility and Permitted Use

We may update these Terms from time to time. Any changes will become effective when posted on the Site, unless otherwise stated. Your continued use of the Site after updated Terms are posted means you accept the revised Terms.

5. Accounts and Account Responsibility

Certain features of the Site may require you to create an account, including business directory features, listing management tools, advertising-related access, or other user features.

If you create an account, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

We reserve the right to suspend, restrict, or terminate any account at any time, with or without notice, if we believe the account information is inaccurate, the account is being misused, these Terms have been violated, or the account creates risk for the Site, our business, or other users.

6. Business Listings, Directory Content, and User Submissions

The Site may allow users, business owners, advertisers, or other parties to submit, claim, edit, upload, post, or manage content, including business listings, descriptions, photos, contact details, promotions, comments, account information, ad copy, graphics, and other materials submitted to the Site ("User Content").

You represent and warrant that you own or control all rights necessary to submit the content, that the content is accurate to the best of your knowledge, that the content does not violate any law, regulation, contract, copyright, trademark, privacy right, publicity right, or other third-party right, and that the content is not false, misleading, defamatory, obscene, abusive, threatening, harassing, infringing, fraudulent, or otherwise unlawful.

By submitting User Content, you grant Broward Bark a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, store, display, publish, distribute, modify, adapt, crop, reformat, enhance, promote, and otherwise use that content in connection with operating, marketing, promoting, improving, and monetizing the Site and our business.

This includes the right to use submitted photos, graphics, reviews, testimonials, listings, ad materials, and similar submissions in promotions, newsletters, social media, marketing materials, and other Site-related uses unless you clearly inform us in writing at the time of submission that a specific item is not to be used in that manner.

We may, but are not obligated to, use editing tools, design tools, photo tools, artificial intelligence tools, spell-check tools, grammar tools, and similar methods to improve the presentation, formatting, readability, image quality, or performance of submitted materials for the best end-user experience.

We do not guarantee that any listing, submission, or other content will be published, displayed, maintained, or remain on the Site. We reserve the right, but not the obligation, to review, edit, reject, remove, suspend, or modify any User Content, listing, ad, event, coupon, promotion, or submission at any time, for any reason, in our sole discretion, including if we believe it is misleading, inaccurate, low quality, off-brand, objectionable, non-compliant, or otherwise not a fit for the Site.

7. Business Listing Accuracy and Advertiser Responsibility

Businesses, advertisers, sponsors, and other submitters are solely responsible for the accuracy, legality, ownership, completeness, and appropriateness of the information, claims, pricing, photos, offers, services, promotions, and materials they submit to the Site.

You are responsible for ensuring that your submitted materials do not infringe the rights of others and comply with applicable law, advertising standards, and any required disclosures.

Broward Bark may review submissions for formatting, spelling, grammar, style, clarity, and user experience, but Broward Bark does not assume responsibility for verifying every submitted claim, promise, service detail, or representation.

8. Listings, Advertisers, and Third-Party Businesses

Broward Bark is a media company, directory platform, and promotional platform. The Site may feature local businesses, service providers, advertisers, sponsors, listings, affiliate offers, promotions, and other third-party content.

We do not own, operate, control, endorse, guarantee, or warrant any third-party business, service, product, promotion, listing, advertiser, sponsor, or offer unless expressly stated by us in writing.

Broward Bark is not the provider of veterinary care, boarding, grooming, training, walking, pet sitting, medical services, legal services, or other third-party services listed, advertised, promoted, or linked on the Site.

Any interaction, transaction, booking, appointment, purchase, communication, or dispute between you and any business, advertiser, sponsor, or third party is solely between you and that third party. You are responsible for evaluating any business or offer before engaging with it.

We are not responsible for the quality, safety, legality, availability, performance, accuracy, pricing, fulfillment, conduct, services, products, or representations of third parties featured on or linked through the Site.

9. Lead Forms and Inquiries

The Site may include lead forms, contact forms, booking inquiries, request forms, quote forms, and similar features that allow you to contact a listed business, advertiser, sponsor, or service provider.

By submitting a form through the Site, you understand and agree that your submitted information may be transmitted to the business, advertiser, sponsor, or service provider you selected or contacted so they can respond to your request.

We do not guarantee a response, appointment, booking, service outcome, quote, availability, lead volume, lead quality, sales result, customer conversion, traffic result, ranking result, or advertising performance from any third party or from use of the Site.

10. Email, SMS, and Other Communications

If you sign up for newsletters, marketing communications, account notices, listing notices, or text messages, or if you create an account, submit a listing, submit a form, or otherwise interact with the Site, you agree that we may send you communications related to Broward Bark, the Site, promotions, transactions, listings, support, operations, or your interactions with the Site, subject to applicable law and any separate communication terms that apply.

By opting in to Broward Bark's SMS notification service, you agree to receive recurring promotional, informational, transactional, or service-related text messages from Broward Bark. Message frequency may vary, but you may receive approximately 4-6 text messages per month. Message and data rates may apply depending on your mobile carrier. Broward Bark does not charge a separate fee for sending text messages, but your carrier may charge fees.

You can opt out at any time by replying STOP to any message. For support, contact us at woof@browardbark.com. Your use of Broward Bark's SMS features is also subject to our Privacy Policy and any separate SMS Terms and Conditions we may post on the Site.

11. Payments, Fees, and Advertising Services

Certain services, products, listings, advertising opportunities, upgrades, or promotional placements may require payment.

If you purchase a paid service, advertisement, listing enhancement, featured placement, sponsorship, or other offering through the Site, you agree to pay all applicable charges and fees as presented at the time of purchase.

Payments may be processed through third-party providers such as Stripe. We reserve the right to change pricing, fees, packages, features, billing structures, and service offerings at any time.

We want advertisers and customers to be happy. Refund requests, credits, or adjustments may be reviewed by Broward Bark on a case-by-case basis and granted or denied in our sole discretion based on the circumstances. Unless otherwise stated in writing, Broward Bark is not obligated to issue a refund once a service, placement, promotion, listing, campaign, or paid feature has been purchased, scheduled, published, delivered, or made available.

12. Affiliate Links, Ads, Sponsored Content, and Promotions

The Site may contain affiliate links, advertisements, sponsored content, monetized placements, contests, giveaways, scratch-off games, and promotional offers. We may earn commissions or referral fees from qualifying clicks, purchases, bookings, or other actions.

You acknowledge that the presence of advertising, sponsorships, listings, affiliate links, or promotional content does not create any guarantee, endorsement, warranty, or representation by Broward Bark unless expressly stated otherwise in writing.

Certain contests, giveaways, games, promotions, or special offers may be governed by separate official rules, disclosures, eligibility requirements, or terms, which are incorporated by reference where applicable.

13. Intellectual Property

The Site, and all content and materials on the Site other than User Content, including text, graphics, logos, branding, icons, design, layout, software, compilations, directory structures, listing layouts, custom copy, photos we own, features, and original content, are owned by Broward Bark, its licensors, or its content providers and are protected by applicable intellectual property and unfair competition laws.

You may not copy, reproduce, modify, distribute, republish, display, transmit, create derivative works from, exploit, train artificial intelligence systems on, scrape, harvest, download in bulk, reuse, mirror, frame, or otherwise use Site content, listings, photos, business data, directory data, structure, or materials without our prior written permission, except for limited personal, non-commercial use that does not violate these Terms.

14. Prohibited Conduct

You agree not to use the Site for any unlawful, fraudulent, deceptive, harmful, abusive, or unauthorized purpose, submit false, misleading, or inaccurate information, impersonate any person or entity, upload or transmit viruses, malware, malicious code, or other harmful content, attempt to gain unauthorized access to the Site, its accounts, servers, or systems, scrape, harvest, crawl, extract, copy, download, collect, or republish any data, listings, photos, reviews, or other Site content without our written permission, interfere with the operation, security, or integrity of the Site, infringe the rights of Broward Bark or any third party, send spam or unauthorized communications through the Site, or post content that is defamatory, obscene, infringing, threatening, harassing, hateful, or otherwise objectionable.

15. Reviews, Comments, and Community Content

If the Site allows reviews, comments, testimonials, uploads, photos, or other community content, you are solely responsible for what you submit.

By submitting reviews, comments, testimonials, images, or similar content, you grant Broward Bark the right to use, display, publish, reproduce, edit, reformat, and promote that content in connection with the Site and Broward Bark's business, unless you clearly state in writing at the time of submission that a specific item is not to be used in that manner.

We reserve the right, but not the obligation, to monitor, moderate, remove, edit, decline, or disable any review, comment, image, or other content at any time and for any reason.

We do not guarantee the accuracy, truthfulness, fairness, completeness, or reliability of reviews, ratings, comments, or community content posted by users or third parties.

16. No Professional Advice

Content on the Site is provided for general informational, promotional, and media purposes only. The Site is not a substitute for professional legal, veterinary, medical, financial, tax, business, or other professional advice.

You should use your own judgment and, when appropriate, consult a qualified professional before acting on information obtained from the Site or from any business, listing, advertiser, or sponsor featured on the Site.

17. Disclaimer of Warranties

The Site and all content, services, features, listings, directories, forms, advertisements, promotions, and materials made available through the Site are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Broward Bark disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, security, merchantable quality, satisfactory quality, or uninterrupted operation.

We do not warrant that the Site will be error-free, uninterrupted, secure, current, complete, accurate, or free from viruses or harmful components.

18. Limitation of Liability

To the fullest extent permitted by law, Broward Bark, Case Breakers, Inc., and their owners, officers, directors, employees, contractors, affiliates, licensors, service providers, successors, and assigns will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunities, expected savings, or other intangible losses, arising out of or related to your use of, or inability to use, the Site or any content, service, listing, advertiser, sponsor, product, promotion, third-party business, or feature made available through the Site.

To the fullest extent permitted by law, if Broward Bark is found liable for any claim arising out of or related to the Site or these Terms, our total liability to you will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us, if any, for the specific service giving rise to the claim during the three months immediately preceding the event giving rise to the claim.

19. Indemnification

You agree to defend, indemnify, and hold harmless Broward Bark, Case Breakers, Inc., and their owners, officers, directors, employees, contractors, affiliates, licensors, service providers, successors, and assigns from and against any claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, that arise out of or relate to your use of the Site, your violation of these Terms, your User Content, your violation of any applicable law or any third-party right, or your dealings with any third-party business, advertiser, sponsor, or service provider featured on or connected through the Site.

20. Termination

We may suspend, restrict, or terminate your access to the Site, any account, any listing, any submission, or any service at any time, with or without notice, for any reason or no reason, including if we believe you violated these Terms or created risk for the Site or others.

The provisions of these Terms that by their nature should survive termination will survive, including provisions relating to intellectual property, content licenses, disclaimers, limitation of liability, indemnification, disputes, and any payment obligations.

21. Governing Law and Venue

These Terms and any dispute arising out of or relating to the Site or these Terms will be governed by the laws of the State of Florida, without regard to conflict of law principles.

To the fullest extent permitted by law, any legal action or proceeding arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in or serving Broward County, Florida, and you consent to the personal jurisdiction and venue of those courts.

22. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

23. No Waiver

Our failure to enforce any provision of these Terms will not be considered a waiver of that provision or of any other provision.

24. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or terms expressly incorporated by reference, constitute the entire agreement between you and Broward Bark regarding your use of the Site, except to the extent a separate written agreement applies to a specific service, advertising package, sponsorship, listing arrangement, promotion, or campaign.
