No purchase or payment necessary to enter, vote, or receive the prize. A purchase, donation, newsletter subscription, or payment provides no additional entries, votes, or advantage in winner selection. Void where prohibited by law.

Photo entries are limited to residents of Broward County, Palm Beach County, and Miami-Dade County, Florida, age 18 or older. These three counties define "South Florida" for this Contest. People outside these counties may vote if they meet the separate voting requirements below. Voting requires no email address or account.

1. SPONSOR AND CONTACT

Dave Digital Group, LLC, a Florida limited liability company doing business as Broward Bark ("Broward Bark" or "Sponsor"), sponsors and administers the Too Cute To Spook Dog Costume Photo Contest ("Contest").

These Official Rules govern this Contest only. The rules for Broward Bark's scratch-off game or other promotions do not apply.

2. ELIGIBILITY

Photo entry and prize eligibility are open only to legal residents of Broward County, Palm Beach County, or Miami-Dade County, Florida, who are at least 18 years old at the time of entry. For these Official Rules, "South Florida" means only these three counties. Residency in another Florida county does not qualify an entrant.

An entrant must have a primary residential address in one of these three counties when submitting the entry. Visiting the area, working in the area, owning a business in the area, or using a local post office box, mailing service, or another person's address does not establish residency. Sponsor will verify the potential winner's residency before awarding the prize, as described in Section 10.

Voting does not require South Florida residency. Legal residents of the 50 United States and the District of Columbia may vote if they are at least 18 years old and have reached the age of majority in their state of residence. Voting remains subject to Sections 6 and 7. Voting from U.S. territories or possessions or outside the United States does not qualify. Voting alone does not establish entry or prize eligibility.

An "entrant" means the eligible person who submits a photo. An "entry" means that person's submitted photo and accompanying entry information. A "participant" means an entrant or voter. The entrant, rather than the animal shown in the photo, receives any prize.

Owners, officers, employees, and contractors of Sponsor who help administer this Contest, any Contest judges, and their immediate family and household members may not enter or vote. Immediate family includes spouses, domestic partners, parents, children, siblings, and their spouses. Test entries and test votes do not qualify for the Contest.

Participants must provide truthful information and comply with these Official Rules. Sponsor may request reasonable proof of eligibility and compliance.

3. ENTRY AND VOTING PERIOD

Entry and voting open October 1, 2026, at 12:00:00 a.m. Eastern Daylight Time and close October 31, 2026, at 11:59:59 p.m. Eastern Daylight Time (the "Contest Period"). Both deadlines use the time in Coral Springs, Florida, regardless of the participant's location.

Sponsor's server records establish submission and voting times, subject to review for a demonstrable recording error. Entries and votes received before or after the Contest Period do not count. Starting an upload before the deadline does not qualify an entry unless the server receives the completed submission before the deadline.

4. HOW TO ENTER AND ENTRY LIMITS

If you meet the South Florida residency and other entry requirements in Section 2, visit the Contest website during the Contest Period. Complete the required fields with accurate information, including your actual city of residence, upload one eligible photo of your dog in a Halloween costume, and affirmatively accept these Official Rules and the photo-use permission. By submitting an entry, you confirm that you are at least 18 years old and reside in Broward County, Palm Beach County, or Miami-Dade County, Florida. No purchase, paid membership, social media account, or newsletter subscription is necessary.

Limit one entry per person and one entry per email address during the entire Contest. Each dog may appear as the subject of only one entry. Using another email address or having another person submit the same dog does not create an additional permitted entry. If a photo shows more than one dog, identify the primary dog for the entry. One photo submission constitutes one entry regardless of the number of dogs shown.

Use an email address that you control and monitor. You must own the dog or have the owner's permission to enter the dog. You must also hold the photo rights and permissions described in Section 5.

Sponsor reviews entries before publication and applies the same content and eligibility standards to all entrants. A submission confirmation acknowledges receipt only. Sponsor may request information needed to review an entry and may reject an entry for a stated violation of these rules.

Voting becomes available after Sponsor approves and publishes an entry. Entry and voting run at the same time, so earlier approved entries may have more time to receive votes. Review can take time, and a last-minute submission may have little or no voting time. Sponsor does not award substitute votes for review time. Submit early to allow time for review.

Once voting starts on an entry, the entrant may not replace the photo or transfer votes to another entry. Sponsor may correct nonmaterial typing errors without changing the photo, eligibility, or vote total. An entrant may request withdrawal by emailing Sponsor from the entry email address. Withdrawal ends that entry's prize eligibility.

5. PHOTO REQUIREMENTS AND PERMISSIONS

Submit a real photograph showing an actual dog wearing an actual costume. Basic cropping, rotation, exposure, and color adjustments are allowed. AI-generated dogs, digitally added costumes, stolen photos, and edits that materially misrepresent the dog or costume are not allowed.

You must have taken the photo yourself or obtained permission from the copyright owner that allows all uses authorized by these rules. Owning the dog or appearing in the photo does not by itself give you copyright permission.

Obtain permission from every recognizable adult in the photo. For any recognizable minor, obtain permission from the minor's parent or legal guardian. Sponsor may request proof of these permissions. Avoid photos containing addresses, license plates, phone numbers, or other private information.

Entries must not contain unlawful, obscene, hateful, threatening, harassing, defamatory, sexually explicit, or infringing material. Entries must not promote another business or contain unauthorized third-party advertising. Ordinary commercial costumes do not by themselves violate this rule, but an entry must not imply that a costume brand sponsors the Contest.

Do not harm, frighten, restrain dangerously, or endanger an animal to create a photo. Costumes must allow safe breathing, vision, movement, and appropriate comfort. Sponsor may reject photos showing cruelty, unsafe handling, or apparent animal distress.

6. VOTING RULES

Voting requires no email address, account, or registration. Voters do not need to live in Broward County, Palm Beach County, or Miami-Dade County, but must meet the separate voter eligibility requirements in Section 2. Sponsor does not collect email addresses through the voting feature. Photo entrants must still provide an email address for entry administration and winner notification as described in Section 4.

The website accepts no more than one vote per entry from each IP address every 24 hours, subject to the device restrictions and fair-play requirements below. Eligible voters may vote for as many different entries as they wish, and entrants may vote for their own entries within the same limits. Voting alone does not enter a voter to win a prize.

The 24-hour waiting period runs from the time of the last accepted vote for that entry, rather than resetting at midnight. For example, a vote accepted at 3:15 p.m. allows another vote for the same entry no earlier than 3:15 p.m. the next day.

Sponsor enforces the limit using both internet connection information, including IP addresses, and device or browser identifiers. Only one vote per entry per IP address and per device may count during each rolling 24-hour period. A voter may not use additional IP addresses or devices to cast extra votes for the same entry within that period.

People sharing a home, office, public Wi-Fi network, mobile carrier connection, or device may therefore share a single available vote for an entry during that period. A shared connection may prevent an otherwise eligible person from voting. Changing devices or connections does not create permission to bypass a limit.

Only votes accepted through the voting feature on the Contest website count. Facebook or Instagram likes, reactions, comments, shares, messages, and other off-site activity do not count as votes. Sponsor does not provide extra votes for purchases, donations, referrals, shares, tags, or newsletter subscriptions.

7. FAIR PLAY AND PROHIBITED VOTING

Participants may not use VPNs, proxies, rotating IP addresses, bots, scripts, automated tools, fake accounts, multiple identities, multiple devices, browser resets, cookie deletion, or other methods to evade a voting restriction or inflate vote totals. Owning more than one device or using a VPN for ordinary privacy does not authorize additional votes.

Buying or selling votes, using paid voting services or vote farms, offering money or other benefits for votes, and participating in organized vote-exchange schemes are prohibited. Do not cast votes on another person's behalf or submit another person's information without permission.

Participants may not manipulate competing entries, submit invalid votes to cause another entrant's disqualification, threaten voters, send spam, or interfere with another participant's lawful participation.

Public vote totals and rankings are preliminary. Sponsor may investigate voting activity, temporarily hold questionable votes, remove invalid votes, and correct recording or display errors. Displayed totals may increase or decrease after review. A screenshot, confirmation message, or displayed lead does not establish a right to the prize.

8. WINNER SELECTION AND TIES

After voting closes, Sponsor will review the results. The eligible entry with the highest number of valid votes will be the potential winner, subject to verification of age, South Florida residency at the time of entry, photo permissions, and compliance with these rules. Votes cannot make an ineligible entry eligible for the prize. Sponsor will not select the winner by random drawing.

If two or more eligible entries tie for the highest verified total, Sponsor will appoint a judge who has no personal or financial interest in any tied entry. The judge will score only the tied entries using costume creativity and originality, worth 50 points, expression of the Halloween theme, worth 30 points, and photo clarity and presentation, worth 20 points.

The highest total score wins the tie-breaker. If scores also tie, the higher creativity score takes priority, followed by the higher Halloween-theme score. If a tie persists, an additional impartial judge will rank the remaining tied entries using the same criteria and must give each a distinct rank. The first-ranked entry will be the potential winner.

If the potential winner forfeits, fails to respond within the stated deadline, or fails verification, Sponsor will email the entrant associated with the remaining eligible entry with the next-highest valid vote total. Sponsor will apply the same tie-breaker when necessary.

Winning depends on valid vote totals and, if needed, the stated judging criteria. Sponsor cannot state fixed numerical odds of winning. Sponsor will award the prize if an eligible entrant completes the required verification and claim process.

9. PRIZE

One winner will receive a check for $250 in U.S. dollars, payable to the verified winner's legal name. The total prize value is $250. Sponsor funds and fulfills the prize and pays standard mailing costs to the winner's verified U.S. address.

The winner may not transfer or assign the prize or require another prize or payment method. Sponsor will not substitute a coupon, discount, or gift card for the promised check. No purchase, handling charge, claim fee, or advance payment to Sponsor is necessary to receive the prize.

The winner bears responsibility for applicable taxes and any charges imposed by the winner's own bank or check-cashing provider. Sponsor may request tax documentation only when legally necessary and will comply with applicable reporting requirements.

10. WINNER NOTIFICATION AND CLAIM PROCESS

Sponsor will email the initial potential winner at the entry email address on or before November 7, 2026, unless a documented integrity investigation requires additional time under Section 15. This initial notification deadline does not require Sponsor to contact an alternate winner before the initial potential winner's response deadline expires.

The potential winner must respond within seven calendar days after Sponsor sends the notification. Sponsor will request the winner's legal name, mailing address, and reasonable proof that the winner met the age and South Florida residency requirements when submitting the entry. Sponsor may also request proof of photo rights or other rule compliance. The potential winner must provide reasonably requested verification within seven calendar days after Sponsor's request, unless Sponsor grants an extension for a documented reason and applies the same standard to comparable requests.

Residency verification may use a government-issued identification document, utility bill, lease, or other reliable documentation showing the entrant's name and qualifying residential address at the time of entry. Sponsor may accept a reasonable combination of documents. A mailing address alone does not establish eligibility. Participants may redact unrelated sensitive information, such as account numbers and identification numbers, while keeping the information needed for verification visible. Sponsor will request only information reasonably necessary to verify eligibility and deliver the prize. Sponsor will not publish verification documents.

Sponsor may require a signed eligibility declaration, confirmation of photo permissions, and prize receipt consistent with these rules. Sponsor will not require a new agreement that materially reduces the promised prize or adds an undisclosed marketing obligation.

If the potential winner does not respond within seven calendar days after Sponsor sends the notification, Sponsor will treat the prize claim as forfeited and email the entrant with the next-highest valid vote total, subject to the tie-breaker in Section 8. Inability to verify eligibility, a material rule violation, or refusal of the prize may also result in forfeiture and selection of the next eligible entrant.

Each alternate potential winner receives a new seven-calendar-day response period beginning when Sponsor sends that entrant's notification email, followed by the same verification process. Sponsor will repeat this process until an eligible entrant claims the prize or no eligible entries remain. A temporary email-delivery problem alone does not establish fraud.

Sponsor will mail the check within 30 days after completing verification and receiving the information reasonably necessary for payment. Contact Sponsor about a missing or damaged check. Sponsor may verify delivery information and stop payment before issuing a replacement. The winner has no right to duplicate payment.

11. DISQUALIFICATION AND VOID ENTRIES, VOTES, AND PRIZE CLAIMS

Sponsor may reject or remove an entry, invalidate affected votes, disqualify a participant, or deny a prize claim when Sponsor reasonably determines, in good faith and based on available evidence, that the participant has:

a. Violated these Official Rules or applicable law in connection with the Contest.

b. Submitted materially false, misleading, incomplete, or unverifiable required information, misrepresented age or county of residence, impersonated someone, or claimed rights or permissions the participant does not hold.

c. Used automated means, scripts, bots, fake accounts, multiple identities, or other prohibited methods to submit entries or votes.

d. Interfered with the operation, fairness, availability, or security of the Contest, website, servers, or related systems.

e. Engaged in abusive, deceptive, unlawful, threatening, harassing, or fraudulent conduct connected with the Contest or its participants.

f. Attempted to exploit a bug, loophole, vulnerability, recording error, or display error to obtain an advantage that these rules do not permit.

g. Attempted to claim a prize without eligibility, obtain duplicate payment, alter or misuse a prize check, or otherwise make a fraudulent prize claim.

h. Attempted to bypass an entry limit, voting limit, verification step, security measure, or anti-fraud control.

i. Purchased, sold, exchanged, incentivized, or knowingly arranged prohibited votes, or directed another person to violate these rules.

j. Submitted content that violates the photo, ownership, permission, or animal-welfare requirements.

Sponsor will apply these rules consistently and will not disqualify an entry arbitrarily. When practical, Sponsor may request clarification or allow correction of a nonmaterial clerical omission without giving the participant an additional entry or voting advantage.

Sponsor may remove invalid votes regardless of the entrant's involvement. Invalid votes alone do not automatically disqualify an otherwise eligible entrant. Disqualification for another person's misconduct requires a reasonable basis to find that the entrant participated in, authorized, or knowingly benefited through prohibited coordination, or otherwise violated these rules.

Sponsor may restrict further participation by a person who violates these rules and may pursue available remedies for unlawful conduct. Administrative decisions are final within the Contest, subject to applicable law and correction of demonstrated errors. These rules do not eliminate legal rights that participants cannot waive.

12. PHOTO LICENSE AND PUBLICITY PERMISSION

Entrants retain ownership of their photos. By submitting an entry, you grant Sponsor a nonexclusive, worldwide, royalty-free license to reproduce, display, distribute, crop, resize, and format the submitted photo and caption to administer and publicize this Contest and promote Broward Bark through its website, newsletters, social media, and related advertising.

This permission includes use with your dog's name, your first name and last-name initial, and your city and state. Sponsor may identify the verified winner using those details and the winning entry. Sponsor will seek separate permission before using your full name, personal testimonial, or unrelated personal image in advertising beyond this permission.

The license continues after the Contest ends for these stated purposes, subject to applicable law. Sponsor may authorize service providers to perform these uses on Sponsor's behalf. The license does not transfer your copyright or authorize unrelated businesses to sell your photo. Sponsor owes no additional payment for authorized uses and has no obligation to use a submission beyond Contest administration.

Sponsor may make ordinary formatting changes but may not materially misrepresent the dog, costume, or entrant. You confirm that you have the authority and permissions necessary to grant this license. Publicly posted content may be copied or shared by others. Sponsor cannot control independent third-party copying.

13. PRIVACY AND COMMUNICATIONS

Sponsor collects and uses entry information and voting records to administer the Contest, display eligible entries, verify eligibility, prevent fraud, enforce limits, communicate about the Contest, deliver the prize, and satisfy legal obligations.

For photo entrants, records may include name, email address, city, county and state of residence, optional phone number, photo, caption, submission information, consent records, and verification correspondence. Sponsor will collect a mailing address and information reasonably necessary to verify the potential winner's age and residence in Broward County, Palm Beach County, or Miami-Dade County at the time of entry.

For voting, Sponsor records technical information such as the IP address, device or browser identifiers, selected entry, and vote timestamp to enforce voting limits and review suspicious activity. Voting does not require or collect an email address. Sponsor may also process website activity under the Privacy Policy and contact details that a person separately provides when requesting support.

The public gallery and Contest publicity may display the photo, caption, dog's name, entrant's first name and last-name initial, city and state, and vote total. Sponsor will not include entrants' email addresses, phone numbers, street addresses, identity documents, residency-verification documents, or individual IP addresses in the public gallery or winner announcement.

Sponsor may use hosting, email, security, fraud-prevention, and other service providers to process information for Contest administration. Sponsor may disclose information when law requires disclosure or when reasonably necessary to investigate fraud, enforce these rules, or protect legal rights. Entering this Contest does not authorize Sponsor to distribute your entry contact information to unrelated advertisers for their own marketing.

The website also uses analytics, advertising, and other technologies described in the Privacy Policy. Those technologies may permit separate data collection by Meta or other providers, subject to applicable consent and privacy rights. The Contest's Meta disclaimer does not mean that the website has no Meta tracking technology.

Sponsor may send photo entrants administrative emails about entry review, verification, voting issues affecting their entries, and the prize. Sponsor may reply to voters who separately contact Sponsor for support. Voting alone does not subscribe a person to email communications. Newsletter signup is optional and requires a separate choice on the form. Declining or later unsubscribing does not affect entry eligibility or vote totals. Providing an optional phone number does not by itself authorize marketing texts. Any marketing text program requires a separate consent process as applicable.

Sponsor will retain personal information only as reasonably necessary for the disclosed purposes, including administration, fraud review, dispute resolution, legal recordkeeping, and any separate newsletter subscription. Sponsor will use reasonable safeguards and honor applicable privacy rights. No online system can guarantee absolute security, but these rules do not waive Sponsor's legal security or breach-notification duties.

If a request requires withdrawal of an active entry, Sponsor will explain that consequence. Sponsor may retain records when law permits or requires retention. For this Contest, these specific privacy and marketing terms control over conflicting general website language, subject to applicable law.

14. WEBSITE SECURITY AND PROTECTION OF RECORDS

Participants may not access nonpublic entry data, harvest email addresses or phone numbers, scrape Contest records or photos in bulk, probe or exploit security weaknesses, introduce malware, interfere with verification, or attempt unauthorized access to accounts, databases, or administrative functions.

Sponsor retains rights in its software, branding, website materials, and original database structure, subject to participants' photo rights and applicable law. Participation does not grant access to private voter records, internal security methods, or confidential business information. This restriction does not limit a participant's statutory right to access their own personal information or information that law requires Sponsor to disclose.

Report suspected errors or vulnerabilities privately to woof@browardbark.com. A good-faith report alone does not violate these rules.

15. TECHNICAL PROBLEMS AND EXTRAORDINARY EVENTS

Sponsor does not guarantee uninterrupted access or compatibility with every device, browser, network, or security setting. To the extent law permits, Sponsor does not accept responsibility for participant input errors, incompatible equipment, interrupted transmissions, or failures outside Sponsor's reasonable control.

If fraud, a security incident, a material outage, a natural disaster, or another event seriously compromises fair administration, Sponsor may pause affected features while investigating and apply proportionate measures to restore fair operation. Sponsor will preserve valid records where possible and post any material action and revised timetable on the Contest website.

Sponsor may adjust a timetable only when reasonably necessary, fair to participants, and legally permitted. Sponsor will not change eligibility, selection criteria, or the prize after launch to favor a participant or avoid awarding the prize.

If Sponsor cannot restore reliable voting results, Sponsor will appoint an impartial judge to apply the scoring and tie-breaking procedures in Section 8 to all otherwise eligible entries received during the Contest Period and select a winner. The same South Florida entry requirements apply to this fallback selection. Sponsor will disclose the reason before applying that fallback. Cancellation without awarding the advertised prize will occur only when applicable law requires cancellation or no eligible entrant can qualify and claim the prize.

16. FACEBOOK, INSTAGRAM, AND META

Facebook, Instagram, and Meta have no affiliation with this Contest and do not sponsor, endorse, or administer this Contest.

To the fullest extent applicable law permits, each entrant and voter releases and holds harmless Meta Platforms, Inc., Facebook, Instagram, and their affiliates from claims, losses, damages, and liabilities arising from participation in this Contest or acceptance or use of the prize.

Participants submit Contest entries and administrative information to Broward Bark, which administers the Contest. Meta has no responsibility for entry review, voting decisions, winner selection, or prize fulfillment. Separate platform and tracking activity follows the applicable privacy disclosures.

The Contest does not require or reward sharing, reposting, tagging other people, or otherwise publicizing the Contest. Participants receive no additional entries or votes for such actions. Direct Contest questions and claims to Broward Bark rather than Meta.

17. RELEASE AND LIMITS ON LIABILITY

To the fullest extent applicable law permits, each participant releases and holds harmless Sponsor and its members, managers, employees, agents, and Contest service providers from claims arising from participation, authorized use of entry materials, or acceptance or use of the prize, including claims based on ordinary negligence.

To the fullest extent applicable law permits, Sponsor excludes liability for indirect, incidental, consequential, special, exemplary, and punitive damages arising from the Contest.

These provisions do not excuse Sponsor from awarding and paying the promised prize. They do not exclude liability for fraud, willful misconduct, gross negligence, or any liability or statutory remedy that applicable law does not allow the parties to exclude. They do not waive mandatory privacy, data-security, consumer-protection, or reporting duties. Where a jurisdiction limits these provisions, those legal limits control.

18. RESPONSIBILITY FOR THIRD-PARTY CLAIMS

To the extent applicable law permits, an entrant agrees to indemnify Sponsor for reasonable damages and costs, including reasonable attorney fees, arising from a third party's claim caused by that entrant's unlawful conduct, knowing rule violation, or breach of the photo ownership and permission promises in these rules.

This obligation applies only to the extent the entrant caused the claim. Sponsor will promptly notify the entrant and provide a reasonable opportunity to respond. This provision does not require an entrant to cover Sponsor's own negligence or misconduct or a settlement that imposes an obligation on the entrant without the entrant's consent.

19. DISPUTES AND GOVERNING LAW

Participants may contact woof@browardbark.com to seek a prompt resolution of a Contest question or dispute. Contacting Sponsor does not waive or shorten any legal deadline.

Florida law governs these rules, subject to controlling federal law and mandatory consumer protections of the participant's state. To the extent applicable law permits, courts with appropriate jurisdiction in Broward County, Florida, will hear Contest disputes. This provision does not take away any right to use a local small-claims court or another forum that applicable law requires.

These Official Rules do not require arbitration or waive class-action rights. These dispute provisions control over any conflicting general website dispute provisions for claims arising from this Contest.

20. WINNER INFORMATION AND GENERAL TERMS

After verification, Sponsor will announce the winner on the Contest website using the public details described above. You may request the winner's first name, last-name initial, city and state, and dog's name by emailing woof@browardbark.com with the subject "Too Cute To Spook 2026 Winner" within 90 days after the Contest closes. Sponsor will not provide private contact information except when law requires disclosure.

Sponsor will make these rules available throughout the Contest and prize-claim process. These rules control over inconsistent promotional summaries. Sponsor will promptly correct conflicting advertising rather than rely on a hidden term to mislead participants.

If a court finds a provision unenforceable, the remaining provisions continue to apply to the extent lawful. Sponsor's failure to enforce a provision on one occasion does not waive the provision for later conduct. Participants accept these rules through the Contest's entry or voting acceptance process.
